COURT CANCELS LAND SALE WITH KEKOVA VIEW

The decision of Antalya Demre Municipality to sell the 24,834 square meter land consisting of two parcels with world-famous Kekova views in Çevreli Neighborhood was canceled by the Antalya 2nd Administrative Court.

The 24,834 square meter land belonging to the municipality in Çevreli Neighborhood was sold by Demre Municipality in November 2024 with two tenders attended by only one person. Of the land consisting of two parcels, parcel 799 was sold for 7 million 636 thousand TL and parcel 794 for 22 million 253 thousand TL. Mevlüt Sarıca, who lives in Çevreli Neighborhood, filed a lawsuit demanding the cancellation of the tender and the stay of execution.

ONLY ONE PERSON ATTENDED THE TENDER

In the lawsuit filed to the Antalya 2nd Administrative Court by lawyer Funda Tolunay Kocakaya on behalf of Mevlüt Sarıca; It was stated in the lawsuit that the municipal council decision regarding the sale of the real estates in parcels 794 and 799 in block 101 in Çevreli Neighborhood was against the procedure and the law, that it was not possible to hold the tender based on this decision, that the tender should be held by open bidding, that even the village headman was unaware of the tender, that the tender was not announced in the necessary places, that both real estates remained on the sole participant Fahri Tokgöz without any competitive conditions, that the tender was not conducted transparently, and that the tender specifications were not given to him, and it was requested that the tender be canceled and the execution be stayed.

RIGHT OF APPEAL IS AVAILABLE

In January, the Antalya 2nd Administrative Court unanimously decided to stay the execution, as damages that would be difficult to compensate may arise if the transaction subject to the lawsuit, which is clearly unlawful, is implemented, as it is stated in the decision text that the tender should be held by closed bidding, with no possibility of appeal. At the final hearing held on March 26, the Antalya 2nd Administrative Court canceled the sale of the lands, with the possibility of appeal to the Council of State.
